Terms of Service

These Terms of Service ("Terms") form a binding agreement between you ("you" or "user") and GEMEGAME LIFESTYLE AND HOBBY SDN. BHD., a private limited company incorporated in Malaysia and trading as GEMEGAME Studios ("we", "us", or "our"). They govern your access to and use of any mobile game, application, website, or service that we publish (the "Services").

By installing, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Services. If you are under the age of majority in your country, you may only use the Services with the involvement and permission of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

2. Licence to Use the Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Services for your personal, non-commercial entertainment on devices that you own or control. All rights not expressly granted are reserved by us.

3. Accounts

Certain features of the Services may require you to create an account or sign in via a third-party identity provider. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. Please notify us immediately if you suspect unauthorised use.

4. In-App Purchases and Virtual Items

Our Services may offer optional in-app purchases of virtual currency, items, or features (collectively, "Virtual Items"). All purchases are processed by Apple App Store or Google Play Store and are subject to those platforms' own terms.

• Virtual Items have no real-world monetary value and cannot be redeemed for cash;
• Virtual Items are licensed, not sold, and may be modified, expired, or removed at our discretion;
• All sales are final, except where required by applicable law or platform policy;
• Refund requests should be directed to the platform of purchase (Apple or Google) in the first instance.

5. User Conduct

You agree not to use the Services to:

• Violate any applicable law, regulation, or third-party right;
• Use cheats, automation tools, bots, mods, or exploit bugs to gain unfair advantage;
• Reverse engineer, decompile, or attempt to extract source code from the Services;
• Interfere with or disrupt the integrity, security, or performance of the Services;
• Harvest or collect data about other users without their consent;
• Impersonate any person or misrepresent your affiliation with any entity;
• Use the Services for any commercial purpose, including unauthorised resale of accounts or Virtual Items.

We reserve the right to suspend or terminate access to the Services for any user who violates these conduct rules.

6. Intellectual Property

All content within the Services, including game design, artwork, characters, music, source code, trademarks, and documentation, is owned by GEMEGAME LIFESTYLE AND HOBBY SDN. BHD. or our licensors and is protected by Malaysian and international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Services except as expressly permitted by these Terms.

7. User Feedback

If you submit suggestions, ideas, or feedback about the Services, you grant us a perpetual, irrevocable, worldwide, royalty-free, and sublicensable licence to use, modify, and incorporate that feedback into the Services without restriction or compensation to you.

8. Termination

We may suspend, restrict, or terminate your access to the Services at any time, with or without notice, if we reasonably believe you have violated these Terms or applicable law. Upon termination, your right to use the Services will cease immediately. Sections that by their nature should survive termination (including Sections 6, 9, 10, 11, and 12) will continue to apply.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL GEMEGAME LIFESTYLE AND HOBBY SDN. BHD., ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) MYR 500.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Malaysia, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the courts of Kuala Lumpur, Malaysia, and you consent to the personal jurisdiction of such courts.

12. Changes to These Terms

We may modify these Terms from time to time. If we make material changes, we will notify you through the Services or by updating the "Last Updated" date above. Your continued use of the Services after the effective date of any update constitutes acceptance of the revised Terms.
